1. Acceptance of Terms

Welcome to ROUNDS. These Terms of Service ("Terms") govern your use of the ROUNDS mobile application (the "App") operated by Stay Pilot LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Age Requirement and Eligibility

You must be at least 21 years of age to use this App. ROUNDS contains content related to drinking games and alcoholic beverages. By using the App, you represent and warrant that:

• You are at least 21 years old
• You are of legal drinking age in your jurisdiction
• You are legally permitted to consume alcoholic beverages where you are located
• You have the legal capacity to enter into these Terms

If you do not meet these requirements, you must not use the App.

3. Description of Service

ROUNDS is a party games application that provides various game modes including prompts, dares, catchphrase-style word games, and card-based games. The App is designed for entertainment purposes at social gatherings. Some game content may reference or suggest the consumption of alcoholic beverages.

4. Responsible Drinking Disclaimer

By using ROUNDS, you acknowledge and agree that:

• You are solely responsible for your alcohol consumption and behavior while using the App
• The App's game prompts and suggestions are for entertainment only and do not constitute advice or encouragement to consume alcohol irresponsibly
• You will not operate a vehicle or heavy machinery while under the influence of alcohol
• You will ensure all participants in games are of legal drinking age and consent to participate
• You will respect the choices of those who choose not to drink alcohol
• You will never pressure anyone to consume alcohol
• You understand the health risks associated with excessive alcohol consumption

Stay Pilot LLC does not encourage excessive drinking or irresponsible behavior. If you or someone you know has a problem with alcohol, please seek help from a medical professional or contact a support organization such as Alcoholics Anonymous (aa.org).

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable federal, state, local, or international law
• Use the App with or around individuals under the legal drinking age
• Attempt to reverse engineer, decompile, or disassemble the App
• Copy, modify, or distribute the App's content without authorization
• Use the App to harass, abuse, or harm another person
• Interfere with or disrupt the App or its servers

6. In-App Purchases and Subscriptions

ROUNDS offers in-app purchases and subscriptions for additional content and features:

• In-App Purchases: One-time purchases for additional game packs, prompts, or features
• Subscriptions: Recurring payments for premium access to all content and features

All purchases are processed through the Apple App Store or Google Play Store, depending on your device. By making a purchase, you agree to the payment terms presented at the time of purchase. Please note:

• All purchases are final unless otherwise required by applicable law
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your device's app store settings
• Refund requests must be directed to Apple or Google, as applicable
• Prices may vary by region and are subject to change

7. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Stay Pilot LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STAY PILOT LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Stay Pilot LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App, including but not limited to any injury or harm caused to you or any third party arising from alcohol consumption or activities related to using the App.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Stay Pilot LLC is registered, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in that jurisdiction.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stay Pilot LLC regarding your use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
